Response to Baker University's Stance on the SLT

In light of recent statements regarding the proposed South Lawrence Trafficway we feel it is important for the public to understand the position of the Jayhawk Audubon Society Board of Directors. Our position is that IF the South Lawrence Trafficway is to be completed, an alignment south of the Wakarusa River is the best alternative.
We understand the position that Baker University has taken that aligns them with proponents of a northern route. We also know that Baker University feels that this is the best way that they can defend the Wetlands. But, this does not mean that the Jayhawk Audubon Society agrees with their position. Nor do we feel it is appropriate for Baker University and KDOT to make decisions about alignments prior to the completion of the Environmental Impact Statement. The purpose of the Environmental Impact Statement is to thoroughly review each alternative so that an informed decision can be made. In addition, the 404b(1) guidelines of the Clean Water Act state that mitigation should only be considered when a determination of unavoidable wetland loss has been made. With the completion of the Environmental Impact Statement we would, if necessary, monitor any mitigation proposals that Baker University presents and will take every opportunity that is available to ensure that the proposals are thorough and genuine.
There are many concerns about whether KDOT is prepared to make any mitigation package work. Are they willing to make sure that funds are available, not only for the initial construction, but for a long term commitment to management and protection? We have concerns about the long-term impacts of road pollution and run-off. We have concerns about how noise can be reduced without compounding the impact on the wetlands with construction of noise barriers. We have concerns about how criteria for success will be established and by whom. These are just a few of the many unanswered questions.
To those legitimately concerned about traffic in Lawrence, we refer them to Mr. Rees, KDOT's attorney, who recently admitted to the Douglas County Commissioners that ANY alignment of the SLT would have negligible impacts on reducing the traffic on 23rd Street.
Baker University has been working for 30 years to reverse the impact that farming and drainage has had on the Wetlands. Jayhawk Audubon has worked for over 15 years to ensure that future generations have the opportunity to enjoy this unique and special place. We feel that those efforts should not be lost or reversed by allowing road construction through the Wetlands.
