REGULAR COUNCIL MEETING

 

               OCTOBER 5, 2005                                           7:30 P.M.

 

PRESENT:  Mike Batchelder, Tony French, Donna Parish, Ken Stewart and Mari Ann Parker (7:35).

 

ALSO PRESENT:  Galen Weiland, Katie Hargis, Dave Reist, Ted Collins, Kelsey Wohletz, Lacey Sullivan, Dick Powell and Bill Butrick.

 

PRESIDING:  Mayor Janet Tyler.

 

The meeting was called to order at 7:30 p.m. with a quorum present.

 

Donna Parish  moved to approve the minutes of the last Regular Council Meeting held

September 7, 2005.  Mike Batchelder 2nd, motion carried unanimously.

 

Ken Stewart moved to approve the minutes of the Special Council Meeting held September 28, 2005.  Tony French 2nd, motion carried unanimously.

 

Donna Parish moved to approve the bills for the month of September, 2005.  Tony French 2nd, motion carried unanimously.

 

PRESENTATIONS

 

Galen Weiland, Director of the Doniphan County Economic Development Committee, asked the city to participate in the inter local cooperative agreement for renewal of the five year program and  for the city to pledge $5000 per year.

 

Consensus of the Council was to get public feed back and make their decision at the next regular council meeting.

 

CITIZENS REQUESTS

 

Katie Hargis requested the city to designate one night for Halloween “trick or treating”.

The Council took no action but did ask that trick or treaters respect the citizens’ by noting that if porch lights are “on” it is OK, if porch lights are “off” to not trick or treat.

 

COMMITTEE REPORTS

 

Law Enforcement Committee Chairman Ken Stewart updated the Council on the progress of the contracting with the Doniphan County Sheriff for law enforcement.

 

Donna Parish moved to grant permission to Highland Community College to pave W. Illinois Street from Prairie to W. Avenue.  Tony French 2nd, motion carried unanimously.

Council member Donna Parish thanked the college for doing this project.

Street and Alley Committee Chairman Mari Ann Parker informed the Council that the pedestrian  crosswalk across W. Main Street from Ellis Hall to the Library Student Union Building had been approved for signage.

 

Mari Ann Parker moved to amend the traffic map to show pedestrian crosswalk signage on the 600 Block of W. Main.  Tony French 2nd, motion carried 4-1 with Batchelder voting no.

 

City Attorney Ted Collins stated he will be sending letters to property owners on Colorado Street and West Avenue explaining options/benefits for expansion and maintenance of those streets.  Mr. Collins also informed the Council that E. Ohio Street had been surveyed.

 

Tony French moved to open Ohio Street from Vermillion to Canada one block to allow for access to the Bill Leach property.  Ken Stewart 2nd, motion carried unanimously.

 

Mayor Tyler appointed the Street & Alley Committee to obtain bids for clearing of trees on E. Ohio Street.

 

City Attorney Ted Collins informed the Council he is researching the law on trash dumpsters being placed in city streets and hoped to have an answer by next meeting.

 

Council member Mike Batchelder updated the Council on the KAN-STEP Grant for the community building.  He stated that a meeting with all volunteers present needs to be scheduled soon and would keep everyone informed of the time and date.

 

Consensus of the Council was to table discussion of the fire department management to a later date.

 

8:55 p.m.  Tony French moved to go into executive session for thirty minutes to discuss personnel.  Ken Stewart 2nd, motion carried unanimously.

 

9:25 p.m.  Donna Parish moved to come out of executive session and asked that Mike Batchelder leave the premises for the next item of discussion.  Ken Stewart 2nd, motion carried unanimously.

 

Tony French moved to extend the duties of Mike Batchelder to include code enforcement officer for city ordinances pertaining to weeds, nuisances and dogs running at large with an additional contracted amount of fifty dollars per month being added.  Motion carried 4-0. 

 

Mike Batchelder was asked to return to the meeting.

 

Ken Stewart moved to accept with regret the resignation of J.D. Euler as Municipal Judge effective November 1, 2005.  Tony French 2nd, motion carried unanimously.

 

9:28 p.m.  Tony French moved to adjourn.  Ken Stewart 2nd, motion carried unanimously.
