The Moran City Council met in regular session on Monday, April 1, 2002. President of the Council Mark Barnet called the meeting to order at 7:00 PM. Councilmembers present were Mike Holman, James Mueller, and Warren Johnson. Mayor Merkel arrived at 7:03 PM. Also present were Bret Heim, City Attorney; Jason Prock, Police Chief; Loretta Roberts, Ambulance Director; Lori Evans, City Clerk; and Mike Stodgell, City Superintendent. Ralph Dozier, Gene Demerit, and Bill McAdam were present representing the Marmaton and Osage Townships. Richard Luken and Sheri Smith, Assistant City Clerk were visitors attending the meeting.

Councilman Mueller moved to approve the April consent agenda consisting of: March 4, 2002 regular council meeting minutes, April pay ordinance totaling $80,339.16, and corporate resolution for purchase of a $20,000.00 certificate of deposit (CD) to replace a CD maturing April 9, 2002. Johnson seconded the motion, motion passed with approving.

CONTRACT WITH MARMATON/OSAGE TOWNSHIPS

Bill McAdam spoke with the Council and advised them that the $10,000.00 contract amount offered by the Council was more that the townships could afford. He said the townships could only agree to a contract amount of $7,500.00 with Marmaton Township providing $4,500.00 and Osage Township providing $3,000.00. After some discussion, Councilmember Mueller moved the Council meet in executive session for 10 minutes at 7:25 PM to consult with the city attorney on matters that would be deemed privileged in an attorney/client relationship. Barnett seconded the motion, motion passed with all approving.

The Council returned to open meeting at 7:34 PM and the Mayor called for discussion or a motion. The Council and Township representatives discussed increasing fuel and insurance prices and allowing provisions within the contract to allow for reconsideration of the terms in the event an extraordinary expense. Chief/Mayor Merkel read the pricing specifications for building a new truck for rural use and offered copies of the pricing to the Marmaton and Osage representatives. Topic was tabled and the clerk was advised to place the topic on the May agenda.

VISITORS

Sheri Smith asked the Council why two employees received raises in March and the remaining employees did not. She asked what the other employees needed to do to merit an additional raise. The Council advised Sheri that they would be reviewing salary pay scales in the May meeting as they begin preparations for the 2003 budget.

OLD BUSINESS

City Services Provided to Residents – Mayor Merkel spoke with the Council regarding two residential requests for services submitted to City employees. One request was for a load of rock for residential use. Another was for the City crew to reconnect electric for a service line (on the resident’s side) damaged during the ice January storm. Mayor Merkel said he denied both requests as he felt clarification was needed regarding the City’s policy regarding services to residents

The Council discussed the request and agreed with the Mayor’s decision regarding the request for rock. The Council did note that emergency situations should warrant special consideration and agreed that the City Superintendent should make the call of what requests deserve merit.

Request from City of Elsmore – The Council continued discussion regarding the City of Elsmore’s request for assistance in replacing electric poles damaged in the January ice storm. The Council concluded that the City of Moran was not in the business of making utility repairs, but would be glad to help in the event of a utility emergency if the City was able. Councilmember Barnett moved to decline the City of Elsmore’s request, Mueller seconded the motion, motion passed with all approving.

Following this discussion, Superintendent Stodgell told the Council that the City had had been contacted by the City of LaHarpe following the ice storm asking if we could sell four electric poles so they could make repairs to their distribution system. Recently, the City of LaHarpe has advised City Hall that they do not need two of the poles and asked if our City crew could pickup the poles. Councilmember Mueller moved to approve LaHarpe’s request if the City of LaHarpe agrees to pay for manpower and equipment time to pick up the poles. Johnson seconded the motion, motion passed with all approving.

Front Street Lift Station Generator - Clerk Evans told the Council that she could not find any documentation requiring that the Lift Station Generator be permanently housed on the premises with the lift station. Topic was tabled until the May Council meeting.

Copier Maintenance Contract – The Clerk reported she had only spoken with one company regarding a maintenance contract on the Konica 7020. Due to ongoing repairs and warranty issues, the Clerk was advised to have all warranty work completed before requesting contract bids. Topic was tabled until the May Council meeting.

DEPARTMENTAL REPORTS

Fire Chief – Chief Merkel said he had spoken with a Fire Knight representative from Veridian regarding the damaged fire helmets. Veridian has sent a sample of the new Fire Knight helmet and offered the City the opportunity of sending the damaged helmets in for repairs free of charge or the City can purchase new replacement helmets with a 50% discount at $125.00 each. The Council asked for the Chief’s opinion, he said he would like to purchase new helmets and try to send the damaged helmets in for warranty repairs. By ordering the new helmets, the fire department would recognize a considerable savings over the full price on helmets. Also, the damaged helmets would be sent in after receipt of the new helmets so that the fire fighters do not run short on equipment. Councilmember Mueller moved to purchase the new helmets at discount, Johnson seconded the motion, motion passed with all approving.

Ambulance Director – Nothing to report.

Police Chief – Chief Prock reported problems with the electrical wiring for the radio and equipment for the police car. He said he has made some repairs but advised the Council that additional repairs may be necessary.

The Chief requested the Council consider purchasing a new protective vest for the police department. He will have pricing details for the May Council meeting.

Superintendent – Superintendent Stodgell reported the following activities for the month of March:

  • Installed nine-meter socket surge suppressors for residents who purchased the suppressors. The City crew still has one suppressor to install for purchase and six residents requesting to rent the surge suppressors.
  • PCB oil collection on hold.
  • Installed water meter at Moran Mini Mart.
  • Re-rocked sewer lagoons and burn pile.
  • Continuing to work on FEMA projects; trimming limbs and replacing house services damaged during the ice storm. 7200 primary line replacements will follow service line replacements.
  • Installation of the new lift station is delayed due to production problems. The lift should be installed around the middle of April.
  • Installed new school speed zone signs and painted signposts yellow to aid in visibility to motorist.
Additionally, he advised the Council of a continuing problem with the exterior security lights burning out quickly on the City Hall/Emergency Complex. Superintendent Stodgell suggested replacing all light fixtures and installing high-pressure sodium fixtures, which will last longer and will be low maintenance.

Superintendent Stodgell told the Council that the Kansas Rural Water Association Conference was very educational. He highlighted a number of issues he would like to see addressed;

  • Tank safety program prepared and implemented for everyone working on or around the water tower.
  • The importance of regular flushing of sewer mains to facilitate the flow of all mains.
  • Researching the installation and use of cathodic protection measures on city water lines.
  • Testing for sludge depths at the city sewer lagoons.
The Council discussed the possibility of employing summer help to work with the City crew. Superintendent Stodgell pointed out the City crew still has quite a bit of work to do that would not be suitable for underage employees. It was agreed not to hire summer help at this time.

The Council also agreed to purchase grass seed locally if the price was right. Additionally, Councilmember Mueller moved to give the Mayor authority to purchase infield conditioner for use at the ballpark. Johnson seconded the motion, motion passed with all approving.

In addition to the regular monthly income, the City received $33,988.65 in FEMA grants for damage to the electrical system, brush clean up, and sewage transportation.

Councilmember Mueller moved the City sponsor a city wide clean up day on May 14, 2002. Johnson seconded the motion, motion passed with all approving.

The Council reviewed a request from Marilyn Bahney, fifth grade teacher at Marmaton Valley Grade School. Mrs. Bahney proposed that her students design a post card promoting our community and asked that the City donate $75.00 toward printing costs. In return, the City will receive 600 post cards. Councilmember Barnett moved to approve the request, Holman seconded the motion. Motion passed with all approving.

The Council discussed continuance and use of the brush pile located at the old sewer plant and agreed to leave the brush pile open for residential use. However, the Council directed police officers to issue warnings and citations to anyone dragging tree limbs or trees over city roadways. Additionally, the Clerk will post notice regarding proper hauling of limbs and brush on the May utility bill.

NEW BUSINESS

Property Condemnations – Councilmember Mueller moved the Mayor be given the authority to sign resolutions, as read by Bret Heim, condemning the properties at 522 N. Locust and 115 E. Hill. Barnet seconded the motion, motion passed with all approving. Property owners at 111 S. Sycamore and 408 N. Birch will receive a letter scheduling a meeting May 28, 2002 regarding the progress on their properties.

OTHER

Councilmember Mueller moved the Council meet in executive session at 9:56 PM for ten minutes to discuss employer/employee matters. Barnett seconded the motion, motion passed with all approving. The Council returned at 10:06 PM, no action was taken.

Councilman Johnson moved the meeting adjourn at 10:08 PM. Barnett seconded the motion, motion passed with unanimous approval.
