February 5, 2007The Moran City Council met in regular session on Monday, February 5, 2007. Mayor Phillip Merkel called the meeting to order at 7:00 PM. Councilmembers present were Mike Holman, Jerry Jackman, James Mueller, Warren Johnson, and Chryll Ginn. Also present were Bret Heim, City Attorney; Shane Smith, Police Chief; Lori Evans, City Clerk; and Mike Stodgell, City Superintendent. Shawn Turner and Dustin Kalp were present to discuss agenda topics. Jamie Jones and Debbie Jones were visitors attending the meeting. Councilmember Mueller moved to approve the February 2007 consent agenda consisting of: January regular Council meeting minutes, February pay ordinance totaling $74,022.88 and corporate resolution for purchase of a $30,000.00 certificate of deposit (CD) to replace a CD maturing February 14, 2007. Ginn seconded the motion, motion passed with all approving.
VISITORSDebbie Jones advised the Council that she would like to take over as Chairman for the Moran Days Committee for this year. The Council discussed services generally provided by the City for the Moran Day Festivities and wished Debbie much success in her endeavors.OLD BUSINESSWater Project Update Shawn Turner advised the Council that the environment reviews were completed and the City is almost ready to complete the loan application with the Kansas Public Water Supply Loan Fund. He also submitted an engineering contract from TranSystems for Attorney Heims review. Clerk Evans noted an error was made in publicizing the Notice of Public Hearing in September 2006 that would necessitate holding another Public Hearing. The Council agreed to hold a public hearing at 10:00 AM on Monday, March 12, 2007. The Council asked Attorney Heim to review the contract before the March meeting and asked the Clerk to place the topic on the March agenda.Dual County Sanitation Agreement Dustin Kalp presented the Council with a revised agreement from Dual County. He noted the revised agreement addressed the Councils concern regarding acceptable containers and provides for a decrease in rates should fuel cost and the Consumer Price Index decrease. As for driver error he noted that it would only apply to areas outside the agreed upon service area. Discussion followed with Councilmember Mueller moving to accept the agreement as written with February 1, 2007 as the effective date. Holman seconded the motion, motion passed with Johnson and Jackman approving and Ginn voting against. Clerk Evans was instructed to inform refuse customers that all refuse must be bagged and that refuse should be placed at the curb by 6:00 AM for pickup. An ordinance increasing residential refuse rates and poly carts will be prepared for the March meeting. Review of Alley Maintenance Policy The Council reviewed excerpts from previous minutes pertaining to this topic and chose to take no action. Burn Permits and Open Burning Councilmember Holman moved a section be added to the code setting a fine schedule of $100.00 to $2500.00 for violation of the Codes and that the fire department design a burn permit application and form. Mueller seconded the motion, motion passed with all approving. Tractor Purchase Superintendent Stodgell asked that purchase of a new tractor be tabled indefinitely as he feels that the City needs to consider replacing the 1986 Ford utility truck instead of purchasing a new tractor. The Council agreed to table the request and asked Superintendent Stodgell to get vehicle pricing and report back at the March meeting. NEW BUSINESS2007 Mileage Rates Councilmember Mueller moved that mileage be reimbursed at the federal rate of .485 cents per mile. Jackman seconded the motion, motion passed with all approving.2007 Jail Agreement with Allen County Law Enforcement Councilmember Mueller moved the City accept the agreement as presented. Holman seconded the motion, motion passed with all approving Proclamation of Family Career and Community Leaders of America (FCCLA) Week Councilmember Mueller moved the Mayor sign the proclamation declaring the week of February 11 through 17, 2007 as National FCCLA Week. Ginn seconded the motion, motion passed with all approving. 2007 Kansas Rural Water Association (KRWA) Conference Superintendent Stodgell requested approval to attend the KRWA conference in Wichita March 27-29. He also requested approval for himself and Asst. Superintendent Miller to attend a 5 hour training class on February 14, 2007 in Iola. Councilmember Holman moved to approve the training requests and to pay lodging, mileage, and meals for the conference. Jackman seconded the motion, motion passed with all approving. Appointment to Allen County Consolidated Law Enforcement Study Group Mayor Merkel informed the Council that the County Commissioners had extended an invitation to appoint a representative to serve on the Allen County Consolidated Law Enforcement Group and that James Mueller had agreed to accept the appointment. Court Management Software The Council discussed the States requirement that municipal Courts begin electronic submission of court convictions by July 1, 2007. Clerk Evans presented pricing from two vendors for software and support. The Council requested the Clerk obtain additional information from approved vendors and to have this information available for the March meeting. Dog Tag Clinic Councilmember Mueller moved to approve that the City sponsor a pet vaccination and tag clinic sometime in March. Ginn seconded the motion, motion passed with all approving. DEPARTMENTAL REPORTSFire Chief Chief Merkel reported the fire department has been working on rebuilding the pump on the older 4WD rural truck and have spent quite a bit of time at the fire department. During the time spent working on the truck he said he has noted a definite lack of ventilation in the building with warm air rising in the fire bays and suggested the Council look for some way to circulate the air. Councilmember Holman offered to bring in some catalogs he has that have industrial fans for the March meeting. No action was taken.Chief Merkel informed the Council that the fire department had received a monetary gift and that he would like to purchase jackets for the volunteers in consideration of the time they invest in the department. He asked if the Council would be willing to help purchase the jackets. Discussion followed; Councilmember Johnson moved the City donate $250.00 towards the purchase of the jackets. Mueller seconded the motion, motion passed with all approving. Police Chief Chief Smith informed the Council that he would participate in a STEP campaign promoting child passenger safety February 12-18. He also noted that he needs to earn a few more credits for continuing education and asked for Council approval to purchase two CD courses from the Kansas Law Enforcement Training Center at a cost of $20.00 each. If he studies and tests for the courses he will receive a total of 8 hours toward recertification. The Council voiced no opposition to the request. Chief Smith asked the Council how they would like him to handle dog owners who do not purchase tags and remit kennel fees as required by city Code. The Council agreed Chief Smith should issue citations to all pet owners in violation of city Code as of May 1, 2007.
Superintendent Superintendent Stodgell submitted the following activity report for the month of January 2007: Superintendent Stodgell advised the Council that Galen Bigelow had purchased new fencing for the west ball field but he does not have the equipment needed to stretch the fencing. He estimated it would take the City crew 6 hours to install the fence and planned to do so unless the Council had objections. The Council agreed the City crew should help install the fence. Superintendent Stodgell also requested approval to build a concrete wash pad near the back shop and estimated the concrete costs between $900.00 and $1100.00. Councilmember Ginn moved to approve the request. Mueller seconded the motion, motion passed with all approving. City Clerk Clerk Evans reported income for the month of January as follows:
Clerk Evans relayed a request from the Library Board asking to use the meeting room at City Hall on February 17th to hold interviews for the librarian position. The Council saw no problem in granting the request. Councilmember Mueller moved the City Codes be modified to include new ordinances and policies approved and passed since the Code was adopted. Holman seconded the motion. Clerk Evans will contact Attorney Heim to ask he begin the process. Councilmember Mueller requested the clerk contact Westar regarding the status of the contract negotiations and have the information for the March meeting. There being no further business to come before the Council, Councilmember Mueller moved the meeting adjourn at 10:28 PM. Jackman seconded the motion, motion passed with unanimous approval.
