June 5, 2006

The Moran City Council met in regular session on Monday, June 5, 2006. Mayor Phillip Merkel called the meeting to order at 7:05 PM. Councilmembers present were Mike Holman, Jerry Jackman, James Mueller, Warren Johnson, and Chryll Ginn. Also present were Bret Heim, City Attorney; Shane Smith, Police Chief; Lori Evans, City Clerk; and Mike Stodgell, City Superintendent.

Councilmember Mueller moved to approve the June 2006 consent agenda consisting of: May 2006 regular Council meeting minutes, June 2006 pay ordinance totaling $56,168.73, and corporate resolution for purchase of a $25,000.00 certificate of deposit (CD) to replace a CD maturing June 14, 2006. Jackman seconded the motion, motion passed with all approving.

Councilmember Ginn moved the Council meet in executive session at 7:15 PM for 10 minutes for consultation with an attorney on maters that would be deemed privileged in an attorney-client relationship. Attorney Heim, Superintendent Stodgell, Chief Smith, and Clerk Evans were invited to attend the session. Johnson seconded the motion, motion passed with all approving. The Council returned to open meeting at 7:25 PM, no action was taken.

VISITORS

OLD BUSINESS

Cereal Malt Beverage Application – Topic was addressed at special hearing.

Water Project – Topic was tabled until the July meeting.

Street Sweeper Rental – Topic was tabled until the July meeting.

Sidewalk Maintenance – Attorney Heim advised the Council that maintenance and repair of sidewalks are the landowner’s responsibility but the City has authority to order landowners to repair damaged sidewalks. The Council agreed that landowners desiring to remove their sidewalk should submit a formal request for the Council’s review.

NEW BUSINESS

2006 GAAP Waiver – Councilmember Johnson moved the Council adopt Resolution 2006-0. Holman seconded the motion, motion passed with all approving.

Water Rationing in the Event of Drought – Clerk Evans informed the Council that Moran South 59 water district had asked for clarification of the City’s water rationing policy in the event a drought should occur. Clerk Evans informed the Council that the agreement with Moran South 59 and two other water districts did not address the need to ration water supplies. The Council requested additional information regarding water use by the districts and to discuss the matter at the July meeting.

Councilmember Ginn asked if the City crew received overtime or comptime pay for putting out the flags on holidays. Superintendent Stodgell said the City crew did not charge any time for putting out the flags. Discussion followed with Councilmember Johnson moving the City crew be paid overtime or comp time when they put out the flags. Ginn seconded the motion, motion passed with all approving.

DEPARTMENTAL REPORTS

Fire Chief – Nothing to report.

Police Chief – Chief Smith reported the radar gun has been repaired is back in service. He also noted the chemical capture class was informative and that he is now certified to use a tranquilizer gun.

Chief Smith informed the Council that he had completed the first round of the STEP grant program by participating in the Click It or Ticket campaign. He will submit a claim for salary reimbursement this week. He also noted he had checked tire prices for the patrol car and that three new tires would run between $385.00 and $400.00. The price for four tires would be about $450.00 but he said he would like to try and wait and replace the tires sometime in July.

Superintendent – Superintendent Stodgell submitted the following activity report for the month of May:

· Painted door stop and installed at Park
· Finished restrooms at Snack Shack
· Cleaned out Concession Stand and rocked around the area
· Removed old backstop fencing and replaced with new fence
· Installed insulation at Concession Stand
· Put fence around new trees at Park
· Wired Concession Stand
· Wired Score board
· Installed new electric service at 412 N. Linn and set utility pole
· Replaced utility pole at 803B N. Cedar
· Replaced electric underground at 213 S. Sycamore
· Changed out transformers at 317 E. First and 213 S. Sycamore
· Put new siren at school parking lot; not wired yet
· Replaced blown fuse at Cook’s alley
· Cleaned out culvert at Chestnut & Franklin
· Cleaned out ditch on Linn Street
· Put used tire on ’78 Chevy
· Repaired crack on outside Library walls; will touch up later
· Repaired loose board at front archway of City Hall
· Kept up with mowing and trimming weeds
· Set post in the alley of the County building to stop big trucks from going through
· Cleaned out culverts around town to ensure proper drainage
· Repaired damaged culvert ends at 637 N. Spruce
· Repaired culverts at intersections of Franklin & Locust, and Walnut & Locust
· Both State water tests passed
· Repaired 2” water meter
· Repaired water service at 614 N. Birch

Superintendent Stodgell submitted a bid from Alan Terrell of $332.00 to brace the park shelter house. Discussion followed and the Council asked the topic be placed on the July agenda.

The Council reviewed a paper submitted by a resident concerning blighted properties. No action was taken.

There being no further business to come before the Council, Councilmember Mueller moved the meeting adjourn at 9:50 PM. With Ginn seconding the motion, motion passed with unanimous approval.
