May 1, 2006The Moran City Council met in regular session on Monday, May 1, 2006. Mayor Phillip Merkel called the meeting to order at 7:00 PM. Councilmembers present were Mike Holman, Jerry Jackman, James Mueller, Warren Johnson, and Chryll Ginn. Also present were Bret Heim, City Attorney; Shane Smith, Police Chief; Lori Evans, City Clerk; and Mike Stodgell, City Superintendent. Lynn Heskett, Audrey Maley, and Steve Crume were visitors attending the meeting. Councilmember Ginn moved to approve the consent agenda consisting of: April 2006 regular Council meeting minutes, May 2006 pay ordinance totaling $45,507.48 and corporate resolution for purchase of a $25,000.00 certificate of deposit (CD) to replace a CD maturing May 20, 2006. Holman seconded the motion, motion passed with all approving.
VISITORSLynn Heskett requested Council approval to include an information sheet detailing summer activities for USD 256’s 21st Century Club with the City utility bills for June. Councilmember Mueller moved to approve the request as long as the insert does not add to the price of postage for the bills.Audrey Maley said she was just visiting and had no business to present to the Council.
OLD BUSINESSWater Rates/Loan – The topic was tabled until the Council received additional information from Turner Consulting.
NEW BUSINESSOath of Office for Mayor and Council – Mayor Merkel administered the oath of office to Councilmembers Chryll Ginn, Jerry Jackman, and Mike Holman.Mayoral Appointments – Mayor Merkel submitted the following appointments for Council approval:
City Treasurer Debra Merkel Councilmember Johnson moved to approve the Mayor’s appointments. Jackman seconded the motion, motion passed with unanimous approval Election of President of the Council – Councilmember Johnson moved that James Mueller be named President of the Council. Councilmember Holman seconded the motion, motion passed with unanimous approval. Cereal Malt Beverage Application – Total Copy Systems DBA Play Mor – The Council reviewed the application and discussed the restrictions on location that would apply to this application. Councilmember Mueller moved the Council recess to executive session at 7:22 PM for 30 minutes to consult with Attorney Bret Heim on matters that would be deemed privileged in an attorney-client relationship. Ginn seconded the motion, motion passed with all approving. The Council returned to open meeting at 7:52 PM. Councilmember Mueller moved the Council hold a public hearing at 6:30 PM on Monday, June 5, 2006 regarding this application as provided by Moran City Code 3-206. Ginn seconded the motion, motion passed with all approving. Review of Proposed Budget for Moran Library – The Council reviewed the 2006 Library budget, no action was taken. Request to Remove Handicap Parking Space at 219 N. Cedar – The Council reviewed the request and advised the parking space in front of 219 N. Cedar is not an official handicapped parking zone and that the business owners could remove the paint from the curb if they wished. Utility Disconnect Notices – Councilmember Ginn moved the City discontinue providing disconnect notices for past due utility accounts. Mueller seconded the motion, motion passed with all approving. The Clerk’s office will publish notice of this action in the June newsletter and on monthly utility bills. 2007 Budget Preparation – The Council was advised the various departments will begin preparing their budget requests this month.
DEPARTMENTAL REPORTSFire Chief – Chief Merkel reported the department responded to a house fire at 222 W. Franklin shortly after midnight on April 24th. Chief Merkel also reported that he ordered a siren control from Chanute Communications as their pricing was considerably cheaper than other competitors. He noted the new siren would be installed near the USD 256 parking lot on Highway 59.Police Chief – Chief Smith notified the Council that the Police Department will participate in the STEP program seat belt campaign May 22-June 4. Smith advised the Council that the rear antenna of the radar gun was not working and was sent for a repair estimate. Councilmember Mueller moved to send Chief Smith to a Chemical Capture class sponsored by the Kansas Animal Control Association in Iola on May 10th. Johnson seconded the motion, motion passed with all approving. Chief Smith informed the Council that he has begun inspections for Code violation related to weeds, abandoned vehicles, and general property conditions. Notices will be sent to properties not meeting the requirements of the City Code. Superintendent – Superintendent Stodgell submitted the following activity report for the month of April:
Superintendent Stodgell reported work at the park on the backstop and concession stand should be completed sometime this week. Superintendent Stodgell noted his concern with loose rock on the streets from last year’s chip and seal project. The Council agreed the City should consider renting a sweeper to pick up the rock and suggested Superintendent Stodgell contact The Rental Station and SE-Kan Asphalt Services. Councilmember Mueller noted the grass was growing up over the sidewalk in front of the Senior/Community Center and that a section of the sidewalk was sinking. Councilmember Johnson also noted a resident had spoken to him about removing a sidewalk on their property. The Council discussed sidewalk ownership and maintenance and requested Attorney Heim review the City Code for review at the June Council meeting. City Clerk – Clerk Evans reported income for the month of May 2006 as follows:
Clerk Evans informed the Council that the Legislature had passed a new law effective July 1st that would require the Council repeal Ordinance 1068 regarding landlord liability for tenants. No action was taken at this time. There being no further business to come before the Council, Councilmember Mueller moved the meeting adjourn at 10:04 PM. With Johnson seconding the motion, motion passed with unanimous approval.
